§ 1 General Provisions

These General Terms and Conditions constitute a binding agreement between the Client and the Translator, i.e. Agnieszka Maniakowska Tłumacz Przysięgły Języka Angielskiego. By using the Translator’s services, the Client agrees to be bound by these general Terms and Conditions. The Translator provides services in accordance with best practices of the industry, acting with all due diligence.


§ 2 Placing Orders

The Client provides the Translator with the text to be translated in paper or electronic form, specifying the expected time limit for and type of translation (sworn or standard). To provide documents in paper form, the Client should make an appointment. Having obtained the information, the Translator prepares an offer with information on the approximate deadline and price.

The order is deemed to be accepted by the Translator when the Client has accepted the terms proposed by the Translator, and if a separate contract is drawn up, the order is deemed to be accepted upon the signing of the contract.


§ 3 Terms and Conditions for Translation Services

A standard page of translation contains 1500 characters, including spaces.

A page of sworn translation contains 1125 characters, including spaces, in compliance with the Regulation of the Minister of Justice on remuneration for services of sworn translators dated 24 January 2005 (Dz. U. 2005, No. 15, item 131).

The charge is calculated to an accuracy of half a page. The minimum charge equals the price of translation of one page.

The price does not include any additional editing work.

Standard translations are provided in any format (paper or electronic). Sworn translations may only be provided in paper form.

Standard turnaround time for translation is 5 pages per day. The turnaround time does not include the order or delivery day.

A surcharge of 50% applies to express delivery (more than 5 pages per day) and handwritten documents.

If the Client cancels the order for translation when the Translator has already begun the work, the Client shall pay for the work done so far, however, the charge shall not be lower than 25% of the estimated charge agreed upon with the Client.

A cancellation of an order may only take place in writing, or in electronic form if it is possible to unambiguously identify the Client.


§ 4 Terms and Conditions for Interpreting Services

Upon placing an order, the Client shall provide the translator with information on the subject and nature of the interpreting service. For specialist interpretation services, the Client shall provide the Translator with reference materials.

Prices are calculated on hourly basis or per half day of work. The time of interpreting service is calculated from the hour for which the Translator has been ordered until the completion of interpreting. Any waiting time is always included.

The minimum charge equals the price of a 4-hour unit. If the time of interpreting in a day exceeds two 4-hour units (8 hours), the price of each subsequent unit shall be increased by 50%. The fee shall also be increased by 50% for interpreting services rendered on the order day, a Saturday, statutory holiday and for interpreting at night (i.e. 8 pm – 6 am). If the Client cancels the order less than 48 hours in advance, a fee of 50% of the agreed assignment price shall be charged.

Travel expenses for longer trips are also payable.

A cancellation of an order may only take place in writing, or in electronic form if it is possible to unambiguously identify the Client.


§ 5 Payment Terms

For the service provided, the Translator shall issue a VAT invoice. The Client who is a consumer as defined in the Civil Code dated 23 April 1964 (Dz. U. No. 16, item 93, with subsequent amendments) shall pay in cash upon receipt of translation; the Client who is an entrepreneur, as defined in the aforementioned act, shall pay by wire transfer within 7 days into the bank account provided in the invoice.

In the event of a failure to pay by the specified payment date, the Translator shall have the right to calculate statutory interest for each day of delay.

The Translator reserves the right to charge an advance payment prior to the commencement of the work, in the amount agreed upon with the Client.


§ 6 Confidentiality

The Translator shall keep confidential any and all information obtained in relation to the translation service.

The Client shall release the Translator from the obligation of confidentiality in the event of a need to prove the fact of performing the translation or its accuracy in a dispute concerning these facts, including a dispute with the Client.


§ 7 Liability

The Translator shall not be liable for delays and defects arising from reasons beyond the Translator’s control, including Force Majeure, hardware and software failure, failure of Internet or telephone connection and a power cut.

The Translator shall not be liable for factual errors in the translation which arise from errors in the original text.

The Translator’s liability shall be limited up to the fee for a given order. Such limitation shall not apply to translations provided for consumers.

The economic copyright to the translation shall be transferred to the Client upon the payment of the full amount of the fee.


§ 8 Final Provisions

Prices provided in the price list do not include the goods and services tax (VAT). Prices provided in the VAT invoice for a given assignment shall be increased by VAT applicable as at the day of issuing the invoice.

The Translator reserves the right to refuse to perform a translation. Any and all disputes between the parties resulting from the services rendered by the Translator shall be resolved amicably, and if agreement cannot be reached, they shall be resolved by the court competent for the Translator’s place of residence; if the Client is a consumer, such disputes shall be resolved by a court competent under general statutory regulations.
